This is a complicated question. Custody can be full time (primary residence) or split time (joint or shared physical custody). If you take this in front of a Judge, the Judge will want to do what is best for the child; there are a lot of things that the Judge will want to know about before making a decision.
I would need to talk this over with you in detail, and then I could give you some guidance. Give me a call, make an appointment to come see me, and let's get moving on this for you. No charge for the telephone call and no charge for the first office visit.

It all depends on all the facts and circumstances of your husband's custody of the child, but custody is his to lose. In other words, it would take some lacking in your husband for him to lose custody. Children are not footballs to be thrown back and forth. If you husband has been
a good custodial parent, not engaging in conduct or behavior potentially harmful to the child, the
other parent will have a very difficult time getting custody, after six years.
