Legal Question in Family Law in New Jersey

My husband took money out of our joint stock acct.

My husband sold stock out of our account and received check for proceeds and deposited it into his own checking account (he just opened). Now he tells me tonight, he is going to move out while we are trying to work on our marriage. He says being apart will be good!

The thing is, he wants to move into a place that he has to sign a year lease, which is $2,000.00+ a month. How can I stop him from signing away part of what is rightfully mine.. Please help....

Thank you.

I know this sounds clich, but you need to run to a good attorney near you. You can file what is called an Order to Show Cause to keep him from taking any marital assets, and spending them. Without a court order, he can do what you describe, and you will have to chase the money in a divorce proceeding.

I have read what the other attorney wrote. Unfortunately, you really do need a good, sharp divorce attorney. NOW. Today. not tomorrow. Your husband could waste a great deal of the money that you will need to raise the kids, and you have to stop it quickly.

Find a good divorce attorney, someone who spends a lot of their time practicing divorce law, who is located not too far from you. Do it today.

If you would like, give me a call; I am in northern New Jersey. I will be happy to discuss this with you; the telephone consultation will be free.
