Legal Question in Family Law in New Jersey

a husband moves out of his house and continues to pay the bills without filling for divorce. During the separation do assets accumulate and then are split in court? Does this separration help for future divorce filling? Is there a time frame that makes it easier for filling?

There is no need to wait to file a divorce because one need only allege inrreconcilable differences existing for six months, without stating what the differences are, to file a divorce complaint. If you are thinking that waiting will mean more assets, that is your prediction. The passage fo time is not always so kind.

The husband is hurting himself. I had one client who kept paying for 9 years! He lost a lot of money as a result.

The husband needs to get going and talk to a divorce attorney.

You do not have to wait for a long time to file for divorce in New Jersey. It is now 'irreconcilable differences', and the differences just have to last 6 months.

Surely his soon to be exwife has been making him miserable for more than 6 months?!
