Legal Question in Family Law in New Jersey

Husband passed before divorce finalized

My divorce papers were FILED on 8-6-03 and my husband passed on 8-16-03. On his death certificate the family marked that he was divorced and we weren't yet. My question is: am I entitled to the vehicles that were in his name because we ARE still married and I am now a widow or does his family get everything? Also, can the family get in trouble for falsifying a death certificate? My lawyer's assistant indicated that it doesn't matter about the death certificate and I shouldn't make a big deal of it and leave it alone. I want it changed to read Married not Divorced. Can you give me some advice or answers? Please help. This is going to get ''ugly'' with his family. They are VERY cold to me now.

Re: Husband passed before divorce finalized

The cases that are controlling in your matter are: Carr v. Carr, 120 NJ 336 "Black Hole; In re Estate of Wilma L. Bilse, 329 NJS 158 (Ch. Div.); Union County; Judge Boyle; In re Estate of Wilma L. Bilse, 329 NJS 118 (Ap. Div.).

I could apply the case analysis to your situation, but I would need much more information from you.
