Legal Question in Family Law in New Jersey
My husband and I are planning to divorce this year. There is a lien on our marital home from a former employer for my husband's breach of contract. What is my financial obligation?

Your "legal oblilgation" is different at this point from whether or not you would be required to pay it if the house were sold. That is because the lien holder does not distinguish between you and your husband when sale proceeds are available. On the other hand, in the context of the divorce proceedings, you could argue that your husband should be responsible for same. There are arguments to the contrary. If the two of you could not agree, then a Judge would make a determination as to who should pay the lien.
Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me at 856-546-8010, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
