ex husband won't sign rebate check

I received a homestead rebate check in the mail made out to both of us. He has been refusing to sign it. He would rather it expire than let me have any of it. Because of his prenupt, he got mostly everything in the divorce. I'm guessing its still a control thing. Is there anything I can do to get the check cash without him. Help?
