Legal Question in Family Law in New Jersey
my husband is being stripped of custody for his son and being awarded to the mother under false accusations. however she doesn't have anything to validate her complaint. he was told by a clerk that it was not necessary for him to file a counter complaint which resulted in everything being awarded to the mother. my husband and I have been his primary care for the child since he was six months and the child is now 4. we have not been able to see him since august because my husband wasn't on the birth certificate however recently paternity was confirmed through the court. she is using the accusation of child abuse from me to also hinder us from being allowed any leverage at all in the situation. she also used her not allowing us to see her son against my husband as to say that he hasn't made any attempt to see him. is there anything he can do to fight for custody?
