Legal Question in Family Law in New Jersey

My ex husband is taking me back to court due to the fact that he refuses to hand over our special needs daughter to my current boyfriend during the custody turn overs. Also he refuses to allow my current boyfriend to watch her as well. My ex husband says that it has nothing to do with the fact that it is my current boyfriend, but i think it is. I have been with my current boyfriend for 8 months and he has watch her before. He is very responsable and has years experience with special needs individuals. My daughter loves him a great deal and there has never been any issues. I dont know if he can win this? Please help. Thanks so much for your time.

Your question raises issues that come up frequently, but the outcome is never predictable because the outcome depends on the sensibilities of the judge hearing the matter. On the other hand, you are no longer married to your child's father and her being in the presence of your boyfriend is not really different from her being in the presence of a new husband. I think the important consideration is that you have a stable relationship with a reputable person who can be trusted, just as a daycare provider would be trusted.
