Legal Question in Family Law in New Jersey
My husband's ex wants her child suppoort payment increased. They have 3 kids. She has 2 more with her current husband. My husband and I have no kids but my non us citizen/green card mom is a dependant. The mediator says that my income can be taken into account in the child support calculation and I cannot believe that I can be penalized this way. My husband makes 180 and I make 140, his ex makes 60, her husband makes 30 He pay 2400 per month plus 200-500 in incidentals EVERY month. This is already outrageous and way above what I calculated was his required payment. The mediator came up with a 3000 per month amount plus incidentals. Please advise. IB

I am somewhat puzzled that you are dealing with a mediator without having the advice of counsel. Your incoime is not imputable to your husband. Your income is relevant only if you and your husband have a child because it would be used to calculate your husband's obligation to the child which you and he had so that obligation could be pluggeed into the calculation of
his child support obligation to his child by his first wife.

Can it be a factor? Possibly. But no, your wages do not get factored into what he owes her.
