inadequate child support

I recently filed for an upward modification of child support. Brief history is my ex seems to be intentionally keeping himself unemployed to keep his payments ridiuously low, under $125 per month. He worked before our child was born but became convienently unemployed so as to not pay adequate support. This has been going on for 10 yrs now. He is not employed and has now been delinquent in payments, my question is will the courts allow this man to continue to be a deadbeat and pay pathetically low payments? Is my mission pointless? He is currently being supported by this current wife, his excuse is he is a "struggling artist." Thanks in advance for any help.

If the Court believes he is keeping himself underemployed solely for the purpose of avoiding a child support obligation, it is likely that they will award you a higher child support amount than it would ordinarily have done with his apparent income.
