Legal Question in Family Law in New Jersey

Increase in child support

my ex and i have a very basic consent order that we agreed to 6 years ago. when doing that i agreed to take less than the guidelines stipulated in child support from him because it was easier to settle than to fight. i didn't want to be in court at all but he had left me with little options, when seeking support i agreed to less because for me it wasn't about the money. 'the times have changed' and i am looking to file a new motion and one of the changes i am seeking will be increase in CS. our consent order states that i can go back for an increase w/o proof of increase in cost of living. currently i am working part time on commission and am not earning any money. my husband is primarily supporting us and i have primarily been a stay at home mom for nearly 3years. can this be used against me? my ex has also changed careers since the CO was in place and is earning much more than before. over the years I have asked for minimal help with daycare/sports/clothing and with the exception of 2x's his response is 'i dont have the money'.

Re: Increase in child support

Your children are entitled to adequate support no matter what agreement for support you made with the father. File your motion for more child support. I will charge you a reasonable fee.

Re: Increase in child support

You should not have a problem getting an increase in child support. Normally, these matters are not complicated and some people do great without an attorney; others are not so lucky. Since these matters are not complicated, it may make sense to have an attorney to help you with this since it may be rather inexpensive. I suggest you at least talk to one or two before going to court.

Good luck!
