If your Complaint is grounded in adultery, there is no residency requirement and you can file for divorce here immediately. If for any other reason, you must be a resident of New Jersey for at least one year, prior to having standing to file. Long-arm statutory constraints must be fully observed to serve your spouse in India. Also, India is not a signatory to the Hague Convention.
