Legal Question in Family Law in New Jersey

interference with custody

My ex and I tried to negotiate a change in the 4th of July holiday , through his lawyer-- we could not agree- He kept the children anyway-- my sister had to call and find out when he intended to bring back the kids. At a later date, he said he paid his attorney to get more time-- and that despite our inability to agree-(all in written correspondence)he says his attorney said do it- 'you'll get a slap on the wrist'-- you paid for it'. My sister says this is interference with custody or contempt of court or something-- What should I do-- I know I need to write a letter at least to the attorney-- What should I say or do about this-- I am very distraught-- and no I do not have an attorney-- I caN NOT afford one-- I am paying off several credit cards for the first battle that lasted 3 years. THank-you for your help-- I need an answer quickly if at all possible : )

Re: interference with custody

hi -you probably should start documenting these violations by filing a police report each time one occurs. even better, call the police each time that he doesn't return them. maybe that will scare him into complying. eventually, with a series of police reports to back you up, you can file a notice of motion without a lawyer to modify visitation, since he hasn't been obeying the court order. as far as the credit card charges, you might want to think about filing bankruptcy to get rid of them and get a fresh start. if you have any other questions, feel free to call me at 609 263-0089. good luck !!
