New Jersey Family Law re: Child Support and College
Father has legal joint custoday. Mother has physcial and residential custody. He pays for out-of-state college. Will court drasctically reduce regular child support? Mother lives on child support now. Mother does not make enough to support herself. Isn't there a law re: double dipping on a parent who pays child support and college at same time? There is no mention of higher education in original divorce decree. Three years ago Mother threatened to move out of state. Long story short, through attorney's and meeting settled by buying her off. Pay for aol at her reseidence, all athleic fees and $400.00 more a month than regulated by child support guidelines. Father makes gross 100,000.00 a year. He pays 1600.00 child support now. He and current wife heavily in debt partially due to still having to buy 50% of clothing and activities for said child.
How do you stop paying for or drasctically reduce child support if you are paying for ou-of-state college?

Child support ends when the child goes away to college because the cost of college includes room and board and clothing. I would have to review the judgment or agreement to determine it requires child support simultaneously with paying for college.
Custody is actually of less importance when a child is in college because it is only attendance at a college that prevents the termination of parental financial obligations when the child graduates high school.
