Does New Jersey offer Legal Seperations?
If a couple in NJ has not lived together for 3 or more years, does NJ consider them legally seperated? Would this also still be the case if the couple maintain a bank account and/or retirement plan together? If they are not legally divorced, who would have the power to make health decisions should either one of them become hospitized? Also, if one purchased the other's half of the house from the other and took the name off the deed, would this spouce have rights to the house regardless if the Will indicates it should go to another member of the family? Thank you.

I agree with the other attorney. You have too many issues to handle through this site. I would recommend just getting divorced if the marriage is over. Its not as bad as everyone makes it out to be and you can get on with your life.
