Joint Custody

I am divorcing my husband, i am not contesting the divorce because I want out. But he put in the divorce papers joint custody. my daughter lives with me. What I would like to know is, who claims her in the taxe documents? He pays for her school fees. Is he required to give me child support. She spends every other weekend with him.

The question as to who shall claim your daughter as a tax deduction must be negotiated between the parties before the divorce is settled. Many times, when there is only one child, the parties alternate the deduction year by year.

Notwithstanding the fact that your husband visits with your child every other weekend, he is certainly obligated to pay child support.
