Legal Question in Family Law in New Jersey

joint custody rights

I have not talked to my son's father for 7 years other than court - now when i inform his mother of apts. I have scheduled for my son regarding medical and educational apts. they inform me that joint custody gives him the right to accompany me on these scheduled apts. He is only doing this now because he is taking me back to court not for the best interest of my son. He is taking me back becase he said I gave him too much time with my son (whenever his mother asked until it hurt his education). Does joint legal custody mean that by law I am forced to sit in a room on scheduled apts with him - or just send him the results from the visits?

Re: joint custody rights

In general, both parents have the right to be at appointments such as these, whether or not there is joint custody or sole custody in one party or the other. This can of course be limited by the Court if there is a determination that it is not in the best interest of the child to have one of the parents there, although quite frankly, unless one of the parents is an ax murderer (so to speak) the Court would be very hesitant to limit this type of access. If you believe there is a reason to bar the father from these appointments, you need to consult with an attorney experienced in Family Law and discuss this with him or her. If you want me to assist you, feel free to call me at 856-546-8010. Good luck!
