Legal Question in Family Law in New Jersey

joint custody

My ex and I share joint custody of our 11 year old daughter. He has her every other weekend and pays $214.00 in child support. I live in New York and he lives in New Jersey. I am remarried and have 3 other children. We have been discussing moving to Florida....what are my rights??

If you have a reasonable basis for moving to Florida and it does not appear that your intent is to deny the father visitation the Court should

grant you an Order authorizing same, if the father will not consent to the move. Before you move you should have something in writing from the Court or that father.

I would suggest getting an attorney to help you with this if he does not consent. Generally, it is not a complicated matter and therefore, not an expensive matter. However, it does require you to file a motion and present evidence, so thus, I suggest getting an attorney.
