Legal Question in Family Law in New Jersey

Jurisdition

I live in NJ but am married to a loser who is abusive, I have family in Ga and want to take our son & go there for safety. Any advise on how I can do this without being changed with any wrong doing??

You need to file for divorce and custody and get permission to move from the court. Although legal custody is not established with either one of you, your husband has the same rights to access as you do.

You should file a domestic violence complaint and ask the judge for permission to move to Georgia at least temporarily. With the restraining order you will be able to control him and you will be able to move legally. Otherwise he can force you to return to New Jersey with the children.
