Legal Question in Family Law in New Jersey

Keeping me away

Recently, my wife's ex called DYFS on us because of his hatred toward us every time we do something about his failure to be a good father. (ie: drugs, no CS, etc.) In any case, the concern of sexual abuse came up. My step-daughter made a statement stating that her ''Dada Edwin'' touched her. However, DYFS forced me out of the home, and said he is to not have contact. After a 6 month long ''investigation'' DYFS finaly made a case plan for me to return home, etc. The judge however, is using a basis, of some juvenile problems I had 7 years ago, when I was 15 years old, and in another state. I did all my treatment nesecary, and everything asked by the courts then, and again when we were under investigation. My concern is, I heard that they can not use things from that long ago, and on a juvenile record as basis to ''punish'' me. My wife needs my help as she is high risk in pregnancy and has been at it alone for half a year. Is there anything federal or State that restricts this type of thing? My name was not even on the papers until this all happened.

The dreamy statements of a young child can have amazing consequences. You will have to counter the comments about your juvenile history by emphasizing your responsible, productive behavior in the last seven years.

Re: Keeping me away

It sounds like are doing this without an attorney. There is no per se law that says juvenile history = no parenting time. In fact, that issue almost never comes up at all. I suggest you consult with an attorney. This should not cost a small fortune for even a good attorney to handle. You really need to fight this as it sounds like things are not going your way at all.

My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
