Legal Question in Family Law in New Jersey

Keeping my son out of college

My son was involved with some drugs in the summer. He's clean now, going to drug counseling and working full time at the moment. He wants to go to college in September in Florida. My ex-husband wants to file a motion to have him stay here, can he do that? My son is 18. I believe it's best for him to go and start his life over and get away from all the bad ''influences'' he had here. He's made great changes in his life now and I think we need to back him up. So at 18, can my ex do anything?

Re: Keeping my son out of college

Can your ex do anything? yes, he can. Exactly what he can do will depend on several things, including what is set out in the Divorce Judgment, in the settlement agreement settling your divorce, and probably other things that you have not mentioned in your question.

I can not predict what he might do without a lot more information.

You want to get this settled before your son goes back to college. If you want your ex to pay part of the college cost, then this is a critically important issue.

Give me a call if you would like. I am in Hackensack, right across from the Bergen County Courthouse. I can speak to you on the telephone, but it will take more than just a brief telephone call to assist you with these issues.

I don't think he can prevent him from moving, but there could be issues with regard to payment for school. I suggest you contact an attorney to help you with this.
