can i kick him out
I would like to know if i can legally kick my husband out of our house, even if up till this point he is still paying the bills, and has already moved to another place, but has yet to actually take all his belongings with him. I would like to have the locks changed, but i would like to know if i could do this legally. I live in NJ, just so you know. Also, is it against the law to like cut up his clothes or do something distructive like that? An immediate reply would be greatly appreciated. Thanks

hi - if you have a restraining order against him, you can get him out. absent that, if he's on the deed or lease, don't change the locks. also, it's probably harassment if you cut up his clothes, so i'd advise you against that as well. it might cause you more problems than satisfaction, in the long run. feel free to call me at 609 263-0089 if you have any other questions. good luck !!

If your husband has already moved out of the marital home, I do not believe that it would be a problem for you to change the locks, especially if you and/or your children face a potential domestic violance situation. However, destruction of property is not a good idea.
