Legal Question in Family Law in New Jersey

late alimony

Ex is severly late with alimony so probation sent complaint to court judge. They said it would be seen by judge and a complaint would be sent to him to appear. they also mentioned a bench warrant. Is this only if he does not appear or answer the complaint. Does this take several days or weeks? Probation wasnt very clear and they do not like you calling more than a couple of times about your case..Thanks

It depends on what they want to do and what the judge wants to do. Sometimes, probation does not issue a bench warrant regardless of how late it is. I have many clients that have to hire me to set the parameters so that probation is forced to act if he misses a certain amount of payments. It is not a very expensive process.
