after a divorce, neither parent can take a child out of state unless: 1. the other parent agrees to it; 2. the divorce judgment or other court order allows it.

you can ask the Judge to order that you be allowed to move out of state or take the child out of state for vacation, and the Judge will grant that motion if there are (to put it short and simple, this is not a complete answer) good reasons to take the child out of state, and if it is in the child's best interests to allow it.

You need a lawyer to assist. moving out of state has so many effects on the child's life and the mother and father's life that you really need to pay some attention and have it handled with care.

without the permission of the other parent or the authorization of a court

order.

Just so you have another opinion, the other two attorneys are correct. This is question comes up at least once every two weeks. If you can get the consent from the other side, then you probably don't need an attorney. Otherwise, I would strongly suggest getting one. The legal term is removal.
