Leaveing the state with children

My sister inlaw lives in NJ she is married w/ 2 children the husband is very verbaly abusive they are not getting along and she wants a divorce. she is affraid when she tells him this he is gonna get very angry and also violent! since neither of them have been awarded custody and there is no type of court order that says she cant leave the state. and there is no attorneys or the state involved yet can she go to Florida where her mother is then tell him she wants a divorce while she is down there to avoid any possible abuse? She does intend on staying in Florida

she really needs to talk to a lawyer before she does anything. she really needs to.

this is what I would tell her:

You have a child (children) with this person. Each child needs to be raised, in a decent apartment or house, needs to be fed, clothed, educated, sent to college maybe, and in general supported and loved. You can do the last part on your own (every kid deserves two loving supporting parents, though), but everything else takes MONEY! Money which we will attempt to get from the child's father.

You need advice from a lawyer. Be prepared to pay for the lawyer's time; it is how the lawyer pays for his/her own bills.

Call if you like; I never charge for a first phone call. You can then decide how you would like to proceed.
