Legal Question in Family Law in New Jersey

Leaving the family home

I am contemplating divorce. My husband & I have 4 young children together. His business is attached to the family home, therefore, I cannot stay here, as he would be here everyday. I do not want to stay here anymore, but am having trouble finding a place to go that is large enough for my kids and myself. My question is, can I leave the family home and stay elsewhere while looking for a home, without risking losing my kids. I would come back to the home everyday to care for them until my husband is done working for the day.

Re: Leaving the family home

I cannot give you a good answer without exploring all of the relevant facts. There are many ways for you to find a new place without leaving the house on a semi-permanent basis. These ways must be explored. Also, perhaps your husband could be confined to certain areas of the house for business times only and then be required to sleep somewhere else. Again, a careful analysis of the facts is necessary before an answer can be given. If you want me to assist you, please call my office at 856-546-8010. Good luck!
