Legal Question in Family Law in New Jersey

leaving the house with my child

Can I legally leave my home and take my child with me if I have not yet filed for divorce or have a court order giving me custody of my child. I am in a verbally abusive relationship and no longer want my child exposed to this behavior

you sound like a woman with troubles. please go see a lawyer. if you can not afford one, please contact Legal Aid.

Make yourself safe. Make your child safe. No, for God's sake, there is no law that says you have to stay where you are being verbally abused! But please, go see a lawyer.

I agree with Mr. Davies, at least meet with an attorney to discuss your options. If anything recent has happened, a restraining order may be an option. I would see an attorney before doing anything.

Good luck.

You can leave the house and take your child with you but you can not premanently leave the state with your child without the other parent's permission or a Court order authorizing same.

Call me if you like.
