Legal Question in Family Law in New Jersey

Hello there

Hello, I'm a legal immigrant here in NJ. Immigrated thru marriage to US citizen. I still don't have my Green Card (my background check is pending). 2 months ago I had a baby. My question is: if I divorce my husband now when I have no status in US what's gonna happen to my baby? And my next question is: if I divorce my husband after I get the Green Card do I get the child custody and what are my husband's rights for the baby? I need full custody, how do I obtain that?

You are asking an immigration question

and a divorce question. If you have your green card a divorce will not effect that status. If you do not have your green card when you file for divorce you will have to consult with an immigration attorney on how to remain in the country.

Full custody means nothing. As the mother you will probably have primary residential custody.
