''legal separation''

if i am legally separated from my spouse and i sleep with someone else, is that considered adultery under nj law?

By definition, as long as you are married, if you sleep with someone else, it's adultery. My question to you is - So what? "Adultery" merely gives the other person the right to obtain a divorce. It has no impact on the determination of child support, equitable distribution, etc. There are some considerations when alimony is discussed; however, in most cases, this becomes irrelevant as well. If you are in a position to even ask this question, you need an attorney. This advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
