Legal Separation
Married in England in 1987. Living in New Jersey over 12 years. Now seeking legal separation. In seeking the separation in NJ will the foreign marriage have consequences or setbacks?

The English marriage will not make a difference to a US court except as to service of the Complaint (you did not state where your spouse resides).
NJ law will apply to issues of support and property distribution. As to enforcement, that will be up to England if there is property there or that is where the spouse resides. Otherwise, it will be determined in the US.
We have dealt with similar problems in the past ans as with all cases much depends on the facts.

The Court's jurisdiction is based on residence, not where you were married. If you have resided in New Jersey for a year you are entitled to file for divorce in New Jersey not matter where you were married.
