Legal Question in Family Law in New Jersey

Legal seperation

If a man leaves his family to co-habitate with another woman is he still financially responsile? Is it legal for him to leave the financial burden on his son and wife? What can be done legally to protect the family against extreme financial burden due to the estranged father?

Re: Legal seperation

If he is not paying voluntarily, or if he is not paying an amount that you believe is appropriate, then you need to make application to the Court to get a Court Order to require him to pay. This is done by a Motion made to the Court. It is generally easier to obtain a lawyer to do this for you. However, each county has a Family Intake Unit that will assist, to some extent, those who cannot afford a lawyer, to process their own applications. You must keep in mind, however, that this advice is based purely on the little bit of information that you have given to me. There certainly could be factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. If you have not retained an attorney, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention Law Guru, there will be no charge for your first consultation. Good luck! Rob Gleaner
