Life Insurance Policy

We agreed in divorce to life insurance policies naming each other as trustee and daughter as beneficiary. Ex has not gotten policy and refuses until he remarries in Oct. Will remarriage have any bearing on the wording of the policy or can he get the policy now? If he refuses to get policy, what are my options in order to get him to follow the divorce terms? Thanks for your help!

Hi,

First, he is required by a Court Order, the Judgment of Divorce, to obtain the life insurance policy. It is enforceable, and the new marriage has no bearing on obtaining life insurance.

I would immediately send him a letter telling him you want proof of the policy immediately. If you don't get it you need to file an enforcement motion. Since it is after the divorce it will take you a minimum of 35 days before a Judge will hear this type of motion. I would suggest you have an attorney help you.

Just file a motion under your divorce to enforce your rights under the final judgment for divorce and requesting attorney's fees for his unreasonable conduct.
