Legal Question in Family Law in New Jersey
I live with the mother of my three year old daughter. The relationship is basically over. The only reason I am there now is because of my daughter. We have been together for 5 years. She doesn't work, refuses to get a job, doesn't have a driver's license, refuses to get one, constantly on the phone or the computer when I come home from work and my daughter is dirty and the apartment is a mess because she doesn't watch her. She doesn't make phone calls to the pediatrician, I do, I take my daughter to all appointments. Do all the food shopping and all the errands and she does nothing.
What do I need to prove to a judge in order to get primary custody. I have heard it's very hard for father's to get primary.

It is really hard for either parent to establish primary custody. Or, said another way, fully litigated custody battles are very emotional and very expensive. It often requires expert witnesses, usually one on each side and very complicated proofs when litigated. All of that being said, full blown custody battles rarely occur because of the expense; so most custody disputes are settled.
