Legal Question in Family Law in New Jersey

I live in NJ and I'm thinking about getting married. I own stocks and 2 homes.

If the marriage ends in divorce is my spouse entitled to any of that?

While a spouse is not generally entitled to share in premarital assets that protection may be lost if the assets are commingled or in other circumstances. The gain on the assets during a marriage may also be viewed as subject to equitable distribution.

We are often engaged to prepare Prenuptial Agreements to protect these assets and the gain from claims of equitable distribution which can be done as long as the parties take care of the issue with separate counsel and full disclosure long before the wedding day.

Sorry, but the answer to your question is YES, if you get married and stay married for a couple of years, your spouse will have a claim on pretty much everything UNLESS you plan it correctly.
