Legal Question in Family Law in New Jersey
I live in Somerset County, NJ. My husband of whom I am seperated from, lives in Hunterdon County, NJ. I already have a restraining order in place as well as child support order and an order for him to pay the household bills he already was paying since we have a handycapped child and I cannot work a 40 hr. week. He has lived in Hunterdon County for approx. 1 year. This past Sat. 02/06/10, I received divorce papers filed by him in Hunderdon County. Since there is already a docket number already on file in Somerset county, should he have filed there instead of Hunterdon? I was under the impression that since the action was already started in Somerset County, that is where the divorce should be filed.

Usually, a divorce complaint is filed in the county were the marital residence is located.
