Legal Question in Family Law in New Jersey
I lived abroad with my wife and child. We separated and got a legal separation outlining custody, visitation, equitable distribution etc.
Now I am back living in the USA and want a divorce. Do I need to state on the complaint custody, visitation etc when this has already been established?

Financial issues and equitable distribution settled by agreement are binding in a divorce, if arrived at fairly. Child custody and support are subject to change based on the best interest of the child.

You need to put all of the agreement in writing, and you and she need to sign it. Then you file for a divorce. A lawyer can really assist you in making this work out correctly for you.
