Living arrangements

We are in the very beginning stages of a divorce, and my wife says it is going to get ugly. We have been married for fifteen years and have four children. We are living in the same house and trying to keep it civil. The problem, my mother in law just arrived from South Carolina to stay with us for two weeks, then my wife plans on taking the kids to SC with her mother on spring break. The visit was a complete surprise to me. She was there when I got home from work. It adds stress and I really don't want her in the house. She has a son that lives 45 minutes away who she could be staying with and supporting her daughter from there. Can I ask her to leave? Does she have a right to stay if my wife asks her to? I fear what she says to the kids when I am not around.

Your mother-in-law has no legal right to be present. But what can you do about it without creating a bigger problem? Not much.

I am guessing the unannounced visit is a strategy ploy which might have been developed after consultation with counsel. It may have been done to provoke you into misconduct with her as a witness/victim especially in front of the children.

The reality is that you are about to face some difficult times. You should get to a lawyer sooner (before the problems grow) rather than later (when the problems are bigger) to develop your own strategy.
