Legal Question in Family Law in New Jersey

Living apart Leaves to separation and divorce

My husband and I have been living apart for sometime due to his job change (but is leading to divorce). I am in another state trying to sell the house now he is trying to stick me with the house note. Is there a way to make him pay the morgage or part of it?

Yeah, I suggest filing for divorce and making an emergent application for temporary spousal support for his half of the mortgage and any other bills he normally pays.

Yeah, there is. File a lawsuit for divorce immediately, and ask the Judge to force him to pay the mortgage and other expenses (taxes, insurance, utilities) on that house until it is sold.

In an action for divorce you could seek spousal support for the mortgage.

In a support action without a divorce you could seek spousal support to pay the mortgage.
