Legal Question in Family Law in New Jersey

How long - No Fault vs Fault

In NJ no-fault divorce can take place after

18 months of separation. If both parties

want a divorce sooner can this be accomplished

by one admitting adultery and the other filing

for fault? Doesn't the 18 month waiting

period encourage this type of 'trick'.

Re: How long - No Fault vs Fault

Thank you for your inquiry.

If both or either party does not want to wait for the 18 month separation, you may proceed with the divorce immediately. However, to do so, it is not necessary for anyone to "admit" adultery.

It would be my pleasure to speak to you regarding your potential divorce. Accordingly, please feel free to contact my office at 732-246-0909.

Very truly yours,
