Re: How long
The reason just about all of the attorneys on here advise you to just call an attorney is that when it comes to family law and divorce, there is rarely an easy answer. In the context of a divorce, 99% of cases settle, so, it is whatever you settle for and not what you are entitlted to. You may be entitled to two different things but your husband wants one of those. Thus, in exchange for giving him one of those, you are going to get something else or more of the other thing. Thus, it really depends on your individual case.
The same goes for alimony. No attorney can tell you how much without getting deep into the case and even that is just an estimate. I call tell you that you will not get lifetime alimony but beyond that, it depends on a variety of factors. If you get married before your alimony ends, your future ex-husband will win a motion to terminate your alimony.
If getting married again is an issue, you can work out an alimony buy out where you get an up front payment which is less than the amount you would get over time. You can then get married with no problems. There are any number of options and there is never a one size fits all for any client.
Thus, a consultation with an attorney is needed to discuss all of the options, your wishes, the facts of the case, etc.
Re: How long
There is no rules that say exactly how long you will get alimony for if you were married 8 years. It depends on a lot of things.
From what you have said, it seems very likely that you are going to have to start a divorce. You need to solve some problems in your life and your children's lives, and a divorce is pretty much needed; that is what I understand that you are saying.
Employment, income to pay the family's expenses, is an issue.
You have kids: custody and vistation, and child support are issues.
Child support and college tuition needs to be paid. Measured in tens of thousand of dollars.
You probably have a house and some money saved. You probably have a pension plan; maybe your spouse has a pension plan.
You need to see a decent, experienced divorce attorney located reasonably near you, and have the attorney to review your situation carefully with you, and give you some guidance. A good attorney could save you thousands of dollars and a great deal of heartache, make your life more manageable, and reduce the harm to the kids. When choosing an attorney, make sure it is someone whose personality works for you, someone you can work with.
If you would like, give me a call; I am in northern New Jersey right across the street from the Bergen County Courthouse in Hackensack. I will be happy to discuss this with you; the telephone consultation will be free.
