Could I lose custody of my kids?
My husband thinks I had an affair--although he has no proof. If he were to get proof, could I lose custody of my kids?

I have read what the other lawyers have written.
It is pretty clear that you ARE having an affair. You should consult with a divorce attorney NOW, before the 'proof' of your affair arrives, and figure out what your options are. You have kids to raise, and this is very important.

Your having an affair is not a consideration in
determining custody unless your affair somehow impacted directly upon your children. The question in the custody determination is "What is in the best interest of the children?"
Secondly, the Court prefers joint legal custody and prefers that the children interact with both parents as equally as possible. Usually, one parent has primary residential custody because it
is usually for the children to equally divide their time with their parents.
