Don't want to make him worse

I'm divorcing and still living in the same house with my soon-to-be-ex. We are also in the middle of a custody battle with a court appointed evaluator. He has been extremely emotionally abusive and refuses to leave. I consulted with my attorney who believes I have grounds for a restraining order, however I'm afraid of the impact it will have on my kids; the custody evaluation; and provoking him further. His weathy family is fueling and financing his war against me, and he won't stop until I'm destroyed. In a nutshell, I'm afraid of what he may do but not physically. I can't even be at ease in my own home. I'm afraid of the impact on my children if they have to watch their father be removed from their home. I'm afraid of the impact on the custody evaluation. I don't want the evaluator to think I'm simply doing it to get revenge although she is well aware of all of the things he's done to me including hiring a private investigator. I also want him to be held accountable for his actions since he thinks he can't be touched. How do you decide if it's worth it to jusst put up with it or get try to get a restraining order?

You may be weaken your case for custody by not filing the domestic violence complaint. Domestic violence is one of the bases of the Court determining custody. You might remember that there are cheap, very sensitive and small recorder which are available which can verify your complaint.
