Legal Question in Family Law in New Jersey

Making property settlement official

My wife has told me that she wants a separation. She has already moved out. Before she moved out we decided on how everything was to be separated including all saved money, the house and it's contents. I have already bought her out of the house and we consider everything at this point to be fully distributed. I want to give the speration time since there is a chance we may resolve all of our issues, but I want the agreement we made to be official. My question is this: Is there any way to make this property settlement official now at the beginning of what might be a full 18 month separation. Once the 18 months is up and we decide to file for a no fault divorce I don't want her to be able to change her mind about the agreement we made.

Re: Making property settlement official

This is a virtually perfect situation for a Mediator. Since you have worked out the details, the two of you could sit down with the Mediator and in a few short hours, at very little cost, you could have a signed Separation Agreement. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. However, since it appears that you have worked everything out, I would suggest that you immediately contact a Mediator,(either me or someone else) to discuss your matter in more detail. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for our first one hour Mediation Session. Good luck! Rob Gleaner
