Mediation is a viable and relatively inexpensive option to settle marital issues. But it only works if there is good faith practiced by both parties. If, for instance, revenge or the desire to garner an unbalanced share of the marital assets is the dominating motive, mediation generally breaks down. In sum, mediation works to save the parties time, money and agravation, if your hearts are right - meaning willing to be fair and equitable and open to dialogue.

You are protected in the sense that mediation is not binding. A good Mediator helps you define the issues, the law governing the issues and facilitate an agreement regarding the same. He or she then drafts a Settlement Agreement, which both parties usually bring to their repsective attorneys for review.

Since you seem to be from South Jersey, may I recommend that you contact my colleague, Jane Herchenroder, Esq. (908-231-9222) who can serve as either a Mediator or as your counsel after Mediation. (Your attorney and the Mediator cannot be the same person. That would be a conflict of interest.) Good luck.
