Legal Question in Family Law in New Jersey
If you are having some marital problems with your wife and are seriously considering divorce but are afraid to do so for fear of the consequences for doing something totally stupid such as setting up a profile of yourself on Match.com cause you to possibly loose your little child now that your wife found out about it even though you never made any physical contact with the other party and only exchanged emails. If I were to file a complaint of divorce, and had proof that my wife intended to visit one of her male friends from her past in NYC ,would my chances be slim in retaining custody of my child or would we be told we were both guilty of violating our marital trust in each other?

Any issues related to children are determined based on the best interests of the children and have nothing to do with the reason for the break up of the parents. As a matter of fact, the reasons that the parents broke up will not determine anything in the divorce proceedings. Marital fault is immaterial in New Jersey divorce proceedings.
