Marriage Name Change
my fiance wants to change his last name and i would take his new last name when married.does he have to do it through the court or can we both change to the new last name when we sign the marriage certificate? thank you

Thank you for your inquiry.
Your fiance must have his name legally changed through a Court Order from the Superior Court of New Jersey. Once finalized, you may simply take his name upon marriage.

In order to change one's name legally, it must be done through the Court. When you marry, you may use his last name legally, but would need to change it with the Social Security Administration and Division of Motor Vehicles. The name change process involves mostly paperwork and service of notices upon several different law enforcement agencies. There are time restraints as well.
