is my marriage legal

my husband was married in england and obtained a divorce there. he never had he divorce papers . when we aplplied for a marriage license . he told the clerk he had never been married . you are under oath and since he did not tell the truth .we are divorcing and is our marriage legal under those circumstances . thank you k. gordon

You are married. If he obtained a divorce in England he was single when he married you. If he was not divorced when he married you he can not use that fact to obtain a divorce because, having defrauded you he has "dirty hands" and is not entitled to claim that you and her were never married.

It seems more likely that he lied about never being married before to avoid the necessity of going through the trouble of obtaining a certified copy of his English divorce decree. You are married.

Are you divorcing because your husband lied on his marriage license application or because he is a liar in general? Is it that he has admitted he was married before he married you but was not divorced when you and he married? How long have you been married and are there children?
