Marriage license

Is a marriage still legal if the witness signs the license with a nickname instead of his/her legal name?

Need more info. If the name is James Smith and he signed it Jimmy Smith, then fine. If the name is James Smith and he signed it "Hondo", then, if challanged, it may be a problem.
