Legal Question in Family Law in New Jersey

what do i do...

I am married with a two year old daughter. We are not a happy couple, and havent been for sometime. I feel like the only reason im there is for my child, and i know that isnt good for anyone. She threatens that she will take my daughter to Puerto Rico, all the time. I have never been arrested, i have a great job, i dont do drugs, i barely drink. What kind of visitation am i lookin at. I wouldnt be able to handle every other weekend with one day during the week. Is a 60 - 40 split out of the question, or every weekend? i have to have my daughter 3 to 4 days a week. Can she take her to Puerto Rico? i never had my father around, so i could never not be there for her. She is a great mother, but we dont work, and i dont want my daughter to see her parents not happy like i saw mine. Please advise me!!!!!!!

More detail would be needed to develop the type of proposed Parenting Plan our office usually seeks.

While some of your goals are doable, a Court is more likely to allow for a 50-50 split but it sometimes happens that scheduling could give you 60-40. We would have to explore your wife's work schedule, etc.

She can not take your child and leave the state without your permission. If she does, a warrant for her arrest can be obtained and she would be brought back to New Jersey in handcuffs. Tell her that.

Secondly, the Court wants the child to experience the child equally, if that is possible. You can have a lot of visitation time if you have the time.

If you don't work, it sounds like it will be difficult to get an attorney. 60-40 is not out of the question. I suggest you contact legal services.
