Legal Question in Family Law in New Jersey
I am married for 5 years no children.Am I enitilted to my part of m y husbands 401 k for the yeats we were married?
1 Answer from Attorneys
You are entitled to a portion of that part of the 401k that accrued during your marriage. It is subject to equitable distribution. That does not necessarily mean one-half. It means a share that is agreed upon between the two of you, or in the absence of an agreement, whatever a Judge decides is fair.
Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner
